Direct from the Commodore…

Two months ago we had a crew of volunteers correct a major safety hazard in front of the exit door leading to the dock area. The concrete was cracked and uneven, causing people to trip. The volunteer group cut the concrete with a diamond saw broke out the old concrete with sledge Hammers and had it removed. Tony Rea had the new cement delivered and led another volunteer group that poured and finished the new concrete. In recognition of the volunteers that worked so hard to improve our club I would like to list the individuals so the membership can walk by shake their hand Commodore

and say thank you for a job well done. Ken Zajac, President of the Blue Gavel, hosted a tiki that had the river front

rocking and rolling. The river traffic know there was a party at the Mariners.

The 3 “B’s”, Barb Hanley, Barb Burns, and Barb Couto hosted a tiki party last week end that gener

ated a good crowed which in turn helped the bar sales for that week end. Thanks Girls.

The Boat Club is looking for more volunteers to host tiki parties. We (the Members) should generate

all the activity we can on that river front. This helps bar sales and attracts new member, everyone

likes a good party.

June was a very busy month at the Club. Bar sales continue to increase. Another new product was added to our line of beer products, Bud Light Lime. When you are at the Club try one. During the month we had a couple of Tiki Parties that were very good. We are trying to add a Tiki Party on Thursday nights. I need some volunteers to help me with this. Tiki Thursday’s we will also have the grill open so we can have Hamburgers and Hot Dogs. Thanks to the Blue Gavel having there Tiki Party and Lisa Zerilli bringing a birthday party to the club at the end of the month,

helping our bar sales.

Jack Lobaido Look for July to be a extremely busy month also. July 12th the Bouys Belle are having there New Member Party. We are also a stop on the MacRay Dingy Run on the 12th also.

June also brought the leaving of Anna. We are sorry to see here go, we wish here the best. Thanks Anna for all your hard work and dedication. If you see a new face behind the bar, I have hired Christy. Please come to the club and welcome her aboard.

On the first page of our web it is stated “The Friendliest Club on Lake St. Clair” if we consider this to be true. Then why do we have members, Flag Officers, Board Members, spouses and significant others -BLAMESTORMING: Sitting around in the club, discussing why a deadline was missed or a project failed, and who was responsible. This is far from the Friendliest Club on Lake St. Clair !

At Mariners we have many issues Mortgage Payments, Membership, Membership Retention and Club Maintenance. These are real issues and the Flag & Board are addressing all these issues and are working for the whole Mariners Boat Club to resolve these issues and not individual issues of Harvey, or Jack or Don or Jacqui or Linda or the board!

I tossed my hat in the ring for this position of Fleet Captain to help our club succeed. But it seems that there is a group that does not want this to happen and they believe the bar crowd runs the club, this is totally absurd. We need to work together. The members elected the board and flag at our annual November election to run the club by working together. We need hard work and cooperation from all members to be the Friendliest Club on Lake St. Clair.

This board has addressed issues from the membership to run the club in a business like manner. We have amended our By-Laws as per membership requests, our By-Laws are considered a living document. Our Club is Governed by the Constitution, By-Laws and Standing rules which are all on the web page for your review.

We all need to be on the same page, Mariners is a 12 month club, the only club that is similar is JYC They have a Pool and we are located on the Clinton river. They have a full time Club and Kitchen Manager, We have Officers and Committees that manage the club and Kitchen, may I mention we don’t get a paycheck for this service.

Since our acquisition of Bumpers and Mariners Landing in 2005, MARINERS has a JEWEL on the Clinton River, we have an excellent view and boat dockage plus additional car parking that was needed.

This is not a rag tag operation like the Little Rascals Clubhouse. We all need to be part of the solution not the problem. Let’s work together and make Mariners the “The Friendliest Club on Lake St. Clair” Continue

We received a complaint on the kitchen cleanliness also the Health department received a complaint on the cleanliness of the kitchen. Next years Commodores ball will be held at the Mirage hall again. Harvey & Mary Karpinski and Jack & Cindy Lobaido are working on a date for the Commodores Ball. The Board has received complaints on the caterer, from the board and members. The board appointed a committee to review , our food catering agreement and the possibility of a new caterer. The Committee is Chairman John Leslie and Linda Gerstenberger, Don Seed and Wayne Polachowski. The KENO license with the State is approved. We are waiting for the State inspection. Our Finance committee is in current negotiations with our mortgage holder to give us some relief on our payments for one year. See you at the Club!
TIKI BAR Saturday August 9th Following the Muscamoot Bay Raft Off
Flabbergasted by the Fleet Don Ruma... We had a great turnout for the Mardi Gras Shakedown Cruise at the Algonac Harbor Club. In spite of the thunderstorms on Saturday afternoon, there were 29 boats and 79 people participating in the rendezvous. Additional boats and members showed up, but did not participate. As new members to the club last fall, this was not only the first rendezvous that we hosted, it was the first rendezvous that we had ever been to. Denise and I would like to thank those that provided support and assisted us during the rendezvous. Unfortunately, not enough boats or people signed up for the Caribbean Christmas in July at Harbor Hill Marina, so we have decided to cancel the rendezvous scheduled for July 18-20. However, Barb Hanley will be hosting a Steak Out on July 19TH at the club. The Sarnia Rendezvous will be reviewed August 1st to see how many boats have interest in going. I know the gas prices are $5 a gallon and that has a lot to do with rendezvous participation. If you have any Ideas to help please contact me. Don Ruma Fleet Captain

Citizen Lawsuits and Uncertain State Requirements Loom

ALEXANDRIA, VA, July 1, 2008 - In response to a federal court order, the U.S. Environmental Protection Agency (EPA) has issued a draft permit for millions of recreational vessels for "normal operational discharges" that could open a Pandora's box of compliance problems and unfairly subject recreational boaters - including those who own canoes and kayaks - to potential nuisance lawsuits.

The EPA draft puts boaters and anglers squarely under new Clean Water Act regulations that go into effect September 30, 2008. The permit requires boaters to comply with a set of worrisome national requirements as well as additional state requirements "to be determined." Penalties carry up to a $32,500 daily fine for each violation.

Boat Owners Association of The United States (BoatU.S.) is urging all boaters and anglers to contact their federal lawmakers to bring corrective legislation to the Senate and House floor for a full vote as soon as possible. The Clean Boating Act of 2008 - S. 2766 in the Senate and H.R. 5949 in the House of Representatives - would restore the federal exemption for recreational vessels for "normal operational discharges" that has been in existence for the past 35 years until the federal courts recently determined otherwise.

"Boaters want clean waters and want to do their fair share, but the draft EPA permit unfairly burdens them with needless regulation," said BoatU.S. Vice President of Government Affairs Margaret Podlich. "The federal courts required EPA to draft a permitting regime that puts individual boaters under the same penalty system as corporate industries even though discharges from a rowing dinghy or motor boat are quite different than those from a large commercial ship with ballast water," said Podlich.

The draft permit would allow the EPA, the U.S. Coast Guard, a state authority or some private contractor to inspect a boat and take discharge samples. If requested, a boater would be required to provide such government officials with information to determine permit compliance.

"What may appear quite simple on the surface will be anything but in reality," said Podlich. "What happens if a neighbor - who perhaps may not appreciate boats - decides that you use too much biodegradable soap to wash your boat, witnesses an accidentally spilled orange juice draining out of the scuppers, or sees you wipe algae off the scum line? Under the present draft permit guidelines, all of these instances may be deemed a violation of the Clean Water Act," added Podlich. "Even topping off a fuel tank, which is recommended for winter storage of today's ethanol-laden gasoline, could be considered a violation," she added.

Also included in the draft EPA permit is the onerous requirement that every state must approve the federal permit before this September 30. Each state may add on its own regulations, potentially creating multiple requirements for boaters cruising between states. After the initial permit this fall, the EPA will then outline for the states how they can implement their own permit systems, which could result in additional state modifications of the permit requirements as well as fees for boaters.

1) This is a member benefit for members only. To be used for birthdays, Showers, anniversary parties. Not allowed Bachelor or Bachelorette parties. 2) The Board shall have authority to approve meetings for other organizations. 3) Meetings and events must be scheduled at a time when it will not interfere with our Club Activities. Present your written request to the rear Commodore for a confirmed date. 4) Fees upstairs $75.00/Down stairs $150 and a $50 Security Deposit to be paid in full at time of contract signing. 5) There shall be no events scheduled on the first floor that have more than 75 attendees during the off season. The pool table will remain open for play during the event. 6) L & R shall have the exclusive right to occupy and operate during the terms of this Agreement the food service facilities of the Client, including the exclusive use of the kitchens, dining rooms, service and storage rooms, as well as auxiliary furnishings, dishes, silverware, linens, and other dining room and kitchen equipment owned by the Client (the "Food Service Facilities"). L & R shall use the Food Service Facilities for the purpose of preparing and serving meals to Club Members, Guests and persons designated by the Client, and for no other purpose, except as may hereinafter be provided. The Client shall have use of the kitchen for fund raising events, Buoys Belles Auxiliary, M.B.G. Past Commodores Club and the pool leagues. The kitchen will be left cleaner than found, if not a twenty five (25) Dollar cleaning fee will be given to L & R by user of kitchen, this will be administrated by the kitchen chairperson. Lessor hereby leases to the Lessee for its exclusive use: Down stairs / Upstairs Room, restrooms, the use of the Lessor’s tables and chairs, together with the non-exclusive use of the adjacent parking area, on the following terms and conditions. This contract DOES NOT include the use of the kitchen. (L & R Catering has the exclusive right to occupy and operate the food service at Mariner’s Boat Club) The Lessee agrees to use L & R Catering.

LESSEE’S PROHIBITED ACTIVITIES: Lessee, Its invitee or licensee shall not: (A) Use staples, nails, tacks, or tape on the walls or ceilings of the premises; (B) Change any lights or lighting fixtures; (C) Permit attendance in the rented premises during the rental period to exceed the posted Fire Marshall and Fire Department regulation of 140 persons; (D) Engage in any conduct which the Lessor in its sole and absolute discretion deems to be offensive or inappropriate, provided that, while Lessor shall have the right of observance and inspection during the period of this lease. Lessor shall have no affirmative obligation to make such observations or inspections; (E) Permit confetti on the premises; (F) Permit exits, halls or passageways to become obstructed so as to interfere with the free/immediate passage of the public; (G) Permit alcoholic and non alcoholic beverages on the premises (all Alcoholic and non alcoholic beverages will be served by the Mariners Boat Club) to meet all legal requirements of Federal, State and County liquor beverage laws; (H) Seek or permit access to any fire suppression area.

  4. LESSEE’S DUTIES: Unless otherwise agreed to by attachment, Lessee shall (A) Return the rented premises to the state of orderliness and cleanliness comparable to such conditions at the beginning of the rental

period; (B) Empty all trash (into outside dumpster); (C) rack all chairs and put the chair racks away; (D) Leave premises and all fixtures and furniture in the same condition as received; (E) Shall see that all patrons clear the PROPERTY 45 minutes after the event is completed. (F) All Guests must be signed in. (G) The member / lessee is responsible and accountable for the guests as long as they are in the club. (H) Member / Lessee must follow all standing rules.

  1. DECORATIONS: Lessee shall not decorate the rented premises without prior consent of the lessor. If such decorations are permitted, said decorations must be removed by the Lessee immediately after the completion of the rental period, unless specific permission is granted to permit such decorations to remain. In NO event will any decorations be permitted that will in any way deface, mar, or injure the premises.

  2. CONDITION OF PREMISES: Lessee has inspected the premises and found same to be suitable for its intended use.

  3. CANCELLATION OF LESSOR: If lessor is forced to cancel this Agreement due to building damage, weather, Acts of God or for any reason not within its control, Lessor shall promptly refund to the Lessee all monies paid with the exception of a $50.00 non-refundable deposit, and neither party shall have any further responsibility or liability to the other under this Agreement.

  4. INDEMNIFICATION OF LESSOR BY LESSEE: Lessee agrees that the lessor shall not be held responsible for any injuries or damages caused by or to any of the Lessee’s invitees while upon the premises except those resulting from the Lessor’s negligence. Lessee shall provide a certificate of liability insurance to the Lessor. Lessee must notify the Hall Administrator (Lessor) named below within 48 hours of any injury or damage incurred.

  5. GENERAL CONDITIONS: This agreement represents the entire Agreement between parties, and neither party shall be bound by any representation not set forth herein. This agreement shall bind the parties, their personal representatives and/or assignees. Whenever used, any gender shall refer to ALL genders and singular shall refer to plural and vice versa.

  6. DEPOSIT: Lessee agrees to a security deposit $50.00 of the hall rental. The security deposit is held and refunded only if the hall is left in an acceptable condition as determined by the Mariners Boat Club.
